16 VSA, Section 1121 - Attendance by children of school age is required - (a) A person having the control of a child between the ages of seven and sixteen years, shall cause such child to attend public school continually for the full number of days for which such school is held, unless such child is mentally or physically unable to attend or is otherwise being furnished with equivalent education, or has completed the tenth grade or is excused by the Superintendent or a majority of the school directors as provided in this chapter.
16 VSA, Section 1122 - Pupils over sixteen
A person having the control of a child over sixteen years of age who allows such child to become enrolled in a public school, shall cause such child to attend such school continually for the full number of school days of the term in which he is enrolled, unless such child is mentally or physically unable to continue, or is excused in writing by the Superintendent or a majority of the school directors. In case of such enrollment, such person and the teacher, child, Superintendent, and school directors shall be under the laws and subject to the penalties relating to the attendance of children between the ages of seven and sixteen years.
The minimum number of days of school attendance required to earn passing grades is 155 in any one school year. In a normal school year, which usually consists of 180 days, this places the maximum number of days of absence from school at 25 days. Absences beyond this number will mean that the year must be repeated if the time is not made up. Students who miss more than 25 days will have to go to summer school or the tutorial center; students with more than 45 days out of a class may not take the course in summer school or tutorial center.
Medical absences of 3 or more consecutive school days will NOT count in this total, provided they are covered by a medical excuse. These notes, indicating the child was under the care of the physician must be given to the attendance clerk, listing illnesses and the days excused as a direct result of the illness.
